In one recent case, a jury awarded $1.2 million to a victim of negligence. We prepare cases to try. We meet court deadlines and we fight to win. We also utilize cutting technology in court to communicate to jurors the way they are used to receiving information: visually and audibly. We also let the clients know that they are important and are often meeting with them at their home or office within 24 hours of first contact. We send them copies of correspondence and pleadings related to their matter and we provide them web access to certain case documents. This fosters the “we are in this together” feeling.
Keeping the Referring Lawyer Involved in the Case
The majority of the firm’s cases come by referral from other lawyers. Many of the referrals are from lawyers who do not handle personal injury or contingent fee cases, but the firm also receives referrals from other personal injury lawyers that do not have the time or resources to properly pursue catastrophic and/or complex cases. WLF primarily receives referrals in Kansas, Missouri and Florida. Each state has its separate ethical rules. For instance, in Florida, the highest referral fee allowed is 25%, unless you petition the court for something different. In Missouri, referral fees are only allowed if the referring attorney if the division is in proportion to the services performed by each lawyer or each lawyer assumes joint responsibility for the representation. In Kansas, a referral fee is allowed so long as the total fee is reasonable and the client is advised of and does not object to the division. We follow these ethical rules for all referrals. To that end, the firm invites referring lawyers to remain involved as little or as much as they wish. Referring attorneys are provided direct access to client documents so the referring attorney can follow the progress of the matter in real time. This allows the referring lawyer to comfortably know that the client has been directed to counsel with the training and resources to maximize the value of their case.
Referring Your Case to Us
Our law practice is largely based on referrals from other lawyers who do not have either the experience or the resources our lawyers have and expend in every case. Our firm partners with other lawyers that refer serious injury cases (accident, malpractice and product liability) to our firm and splits co-counsel fees with referring lawyers consistent all applicable rules.
